Rosarium Terms and Conditions for Online Orders

1 Scope

These general terms and conditions apply, which are incorporated into your offer when you place your order.

2 Conclusion of contract

The customer makes a binding offer using the "PAY NOW" button. The contract is only concluded when Rosarium Rahmat Sharifi sends the customer an order confirmation by email within five days. The contract is concluded directly between the customer and Rosarium Rahmat Sharifi.

The listing of the goods on this homepage does not constitute a contractual offer, but is only an invitation to you to make an offer under the conditions presented.

By placing your order, you are making a corresponding, legally binding offer, which may be accepted by us through consistent behavior (direct debit, credit card debit, electronic invoice sending or sending of the ordered goods).

Immediately after receipt of your order, you will receive an order confirmation in text form, which does not constitute acceptance of your contract offer, but is primarily for your information.

The customer bears the risk of late standard delivery by one working day.

The Rosarium assumes no liability for spelling errors in the order.

5 Prices, shipping conditions

Shipping conditions

Delivery takes place via our partner DHL at the usual delivery times. Standard delivery takes place from Monday to Friday from around 08:00 to around 19:00 and on Saturday between around 08:00 and around 16:00 with our delivery service DHL, but please note that with standard delivery 95% of packages reach the recipient on the desired date. In exceptional cases (2-5%) delivery may be delayed by 1 to 2 business days. We have no influence on this. Delivery on Sundays and public holidays is generally not possible.

Other shipping conditions

In the event that the shipment cannot be delivered due to incorrect address information, a missing recipient name on the doorbell or mailbox or a refusal of acceptance by the recipient, the purchase price plus shipping costs must still be paid. Losses in quality due to late collection from a neighbor or depot are also borne by the purchaser. In this case too, the purchase price plus shipping costs must be paid.

Our terms and conditions are based on DHL's general terms and conditions.

In any case, we will get your shipment on time. Since flowers are fresh, each shipment is only handed over to DHL one working day before the desired delivery date. The desired shipping method will be displayed to the customer with the shipping costs incurred during the order.

6 Subject to change

Flowers are seasonal goods. Due to the possibility of placing orders with us for deliveries that are only to be made after weeks or months, in individual cases it is possible that certain flowers will not be available on the delivery date. In such a case, we will inform you and give you the opportunity to change your floral greeting or, if you wish, cancel the order. If you cannot be reached by us using the contact details you provided or cannot be reached in a timely manner, we reserve the right to unilaterally change the subject matter of the service in such cases. However, we will stay as close as possible to the model of the bouquet ordered and, if necessary, deliver flowers of higher value and quality.

7 Cancellation policy

You have the right to cancel this contract within fourteen days without giving reasons. The withdrawal period shall be fourteen days from the day on which you or a third party designated by you who is not the carrier took possession of the goods or has.

In order to exercise your right of withdrawal, you must contact us (Al wasl Sports Club
opp. Latifa Hospital St-Al Jadaf Dubai- United Arab, info@rosarium.me, telephone: +97148769338) by means of a clear statement (e.g. B. a letter sent by post, fax or email) about your decision to withdraw from this contract. You can use the attached sample cancellation form, although this is not mandatory.

In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will have to pay you all payments we have received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proofthat you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day deadline has expired. We bear the costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling other than what is necessary to check the nature, properties and functionality of the goods.

Exceptions to the right of withdrawal

Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts:

8 Returns

We urge you to send us your request to take it back in text form. We will then immediately send you a return stamp with which you can return the goods to us without incurring shipping costs.

Maturity

The customer is obliged to pay in advance and the purchase price is due immediately after ordering.

Payment modalities

Payment can be made by credit card (VISA, MasterCard) and Paypal.

Consequences of delay

The costs of returning or not redeeming a direct debit for which the customer is responsible must be borne by the customer. This does not affect any further claims for damages by The Rosarium. In the event that a reminder from The Rosarium remains fruitless, The Rosarium may assign the claim to a debt collection company.

Retention of title

In any case, the delivered goods remain the property of The Rosarium until the purchase price has been finally paid.

Offsetting ban

Offsetting by the customer is only permitted if his alleged counterclaim is undisputed, legally established or a legal dispute over this claim is ready for a decision.

10 Place of jurisdiction and applicable law

The place of jurisdiction for registered traders, legal entities under public law, is 60314 Frankfurt am Main. Mutual claims between The Rosarium and persons acting as part of their commercial or independent professional activity are subject to the law of the Federal Republic of Dubai.

11 Liability

Liability of The Rosarium, its representatives and vicarious agents is excluded unless damage is due to a grossly negligent or intentional breach of duty. This does not apply to the negligent breach of obligations, the fulfillment of which enables the proper execution of the contract in the first place, the breach of which endangers the achievement of the purpose of the contract and on whose compliance you as a customer regularly rely. For commercial transactions, liability is also limited to the damage typically caused by transactions of this type.

The previous paragraph does not apply to damages resulting from injury to life, body or health. Any liability arising from the Product Liability Act remains unaffected.

12 Online dispute resolution

Online dispute resolution in accordance with Art. 14 Paragraph 1 of the ODR Regulation: The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/ (link is external).
